If you own or manage a mobile home site, you must be a fit and proper person to manage the site.

You must apply to us for inclusion in our public register of fit and proper persons.

The purpose of the fit and proper person test is to improve the standards of mobile home site management.

A site is exempt if it's a non-commercial, family-occupied site. This means it is:

  • only occupied by members of the same family
  • not run on a commercial basis

If you operate a mobile homes site, you must apply to us for the relevant person (yourself or your appointed manager) to be included in the local register of fit and proper persons to manage a site.

The fit and proper person must be the person with day-to-day responsibility for managing the site.

If the site owner is a company or a corporate body, the appropriate person must complete the application form. This could be:

  • a director or other officer of the company
  • a partner, where the site owner is a partnership
  • a member of the management committee

We base the application fee on the estimated resources required to assess an application.

Supporting documents

You will also need to submit the following supporting documents:

  • proof of your estate or equitable interest
  • evidence of the experience and competency in managing caravan sites of the person(s) named
  • details of the management structure
  • funding arrangements for the site
  • a criminal record certificate for each individual responsible for the day-to-day management of the site
  • a DBS certificate for each relevant person, responsible person or relevant officer dated within six months of the date of the application (you can get a DBS check on GOV.UK)

You must show that there are suitable financial and management arrangements in place for the site.

You must also provide information about:

  • offences relating to fraud, dishonesty, violence, arson or drugs or listed in schedule 3 of the Sexual Offences Act 2003
  • contraventions of law in relation to housing, caravan sites, mobile homes, public health, planning or environmental health or landlord and tenant law
  • contraventions of law in relation to the Equality Act 2010, or in connection with the carrying out of any business
  • harassment of any person in connection with the carrying out of any business
  • insolvency within the last 10 years
  • disqualification from acting as a company director within the last 10 years
  • proof of right to work in the UK

Once we receive your application, we will consider your application and assess whether you are a fit and proper person to manage the site.

We will make a decision whether to place you on the register with or without conditions.

During the assessment process, we may contact you to discuss your application and ask for further documents.

When making a fit and proper person assessment, we assess:

  • whether the relevant person has a sufficient level of competence to manage the site
  • the management structure and funding arrangements for the site
  • information about the relevant person and responsible person
  • conduct of any person associated or formerly associated with the relevant person
  • any other relevant matters (this may include, but is not limited to our history of engagement with the site, compliance issues or other complaints whether received by us or another regulatory body)

We may need to assess anyone who appears to have involvement in the day-to-day management of a site, to assess if they are fit and proper.

Once we have completed the assessment, we will either:

  • grant the application unconditionally, or
  • grant the application with conditions (in which case we will send a preliminary notice with and provide 28 days in which to make representations) or
  • rejecting the application

An entry onto the fit and proper person register lasts for up to five years.

We charge an annual fee if there are conditions on the entry. You can view the fee policy.

You have the right to appeal against a decision or condition.

We must keep a public register of fit and proper person applications. This means that some of the information you provide in your application will be on the register.

The information on the public register will include:

  • the name, business address and contact details of the relevant person, and
  • the name and address of the site

We may review an entry onto the register if we receive relevant information in the future.

Anyone operating a site who fails to comply with the fit and proper person requirements will be committing a criminal offence. They are liable, on summary conviction, of a fine up to level five (unlimited).
