The Local Authority considers that s.88(1) (a) and (b) of the Localism Act 2011 are satisfied and therefore do not have a discretion not to list the asset.

The reasons are as follows:

• there is an actual current use of the building or other land that is not an ancillary use furthers the social wellbeing or social interests of the local community, and
• there is an actual current use of the premises that furthers the social wellbeing or social interest of the local community. s.88(6) of the Localism Act 2011 defines ‘social interests’ to include in particular, recreational and sporting interests
• it is realistic to think that there can continue to be (or in the next five years) non-ancillary use of the building or other land which will further (whether or not in the same way) the social wellbeing or social interests of the local community
• it is realistic to think that the use can continue, as the premises is in active use and there is no indication of the use ceasing. The Parish Council are actively supporting the cricket club. The owner has indicated their support, so it is realistic to think that the owner and the Parish Council will work together to ensure as far as possible, a continued community use.
