Apply for a Deed of Variation
You can use this form if you require a Deed of Variation to a Section 106 Agreement or a Nomination Agreement.
You will need to pay a fee if your request requires the involvement of our Housing Policy Team, which is part of Spatial Planning Services.
This fee applies if you require variations to a S106 Agreement, or to a schedule of a S106 Agreement, if they relate to any of the following:
- Affordable Housing
- Self Build and Custom Build
- Build to Rent
- Affordable Housing on a Build to Rent Scheme
- Travelling Showpeople
- Gypsies and Travellers
- Specialist Residential Accommodation
The fee also applies if you require a Deed of Variation to a Nomination Agreement.
The fee is £1,200 (VAT is not applicable) per Deed of Variation, and you will need to pay before we can process your enquiry.
This fee is non-refundable.
You need to provide as much information as possible within the form to ensure that we can deal with your enquiry as fully as possible.
If you require more than one Deed of Variation, you need to fill out a separate application for each agreement.
