Consultation on draft Planning Obligations SPD

We are preparing a new draft Planning Obligations Supplementary Planning Document (SPD) to support the new Local Plan.

The consultation to gain feedback on the document, and on some minor amendments to our Community Infrastructure Levy (CIL) Regulation 123 List, has now closed.

We are reviewing the feedback and will decide if we need to make any changes.

The Development Policy Committee considered all of the representations we received during their meeting on 8 November 2018.

We will consider any subsequent changes to the SPD after the Examination of the Local Plan.

Planning obligations, or Section 106 Agreements, are agreements that we make with developers to make development acceptable.

You can look at the Planning Portal for more information about planning obligations and what they mean for developers and developments.

The SPD identifies topic areas where we may need planning obligations to provide or pay for new infrastructure to manage the impact of development.

The new draft SPD will include the areas we have identified for development in the new Local Plan.

Each section of the SPD sets out:

  • the policy for requiring obligations
  • when a developer needs to make a contribution
  • when we need to add a planning obligation
  • any exceptions


The Community Infrastructure Levy (CIL) is a charge we apply to new developments, to help to fund improvements to infrastructure.

Our Regulation 123 List shows the infrastructure we are planning to fund using CIL.

The changes we proposed to the CIL Regulation 123 List are minor and only for clarification, so do not need a full review.

The Regulation 123 List goes through a different process when we make changes than the process for changing the SPD. Therefore, we do not need to wait for the for formal adoption of the full SPD.

We will publish the revised list later in November.

Now that the consultation has closed, we will consider all of the comments we receive and decide if we need to make changes to the SPD.

When we adopt the new SPD, it will replace the existing document. We will not adopt the new SPD  until after we adopt the new Local Plan.

We can implement the proposed changes to the Regulation 123 List before we adopt the full SPD. We will publish more details on how we will adopt the revised List after we have reviewed the volume of responses.
